Opening Statements…and Beyond: A Strategic Approach to Mediation – A Workshop by Gerald Clay, Esq.

May 19, 2017, 1:00 – 4:00 PM Hawai’i Supreme Court Conference Room, Ali’iolani Hale, 417 South King Street, 2nd Floor Honolulu, HI 96813      In relationship-based disputes, beneath the facts presented to the mediator lie a host of other unstated issues (the res) that the parties bring to the mediation. A successful resolution may depend upon identifying and exploring these issues. This Workshop will examine strategies and techniques to identify the unstated issues beginning with the Opening Statement. Scenarios of disputes, including complex, multimillion-dollar, relationship-based conflicts and family disputes will be considered. Jerry Clay Jerry Clay believes that virtually all problems arising out of relationships should be mediated before the parties consider the legal system. Trained as a commercial mediator in 1984, he has written a book and published many articles proposing a change of society’s mindset to “THINK MEDIATION FIRST”. He has mediated over 1,000 matters, both large and small and along the way has developed innovative techniques and strategies which he gladly shares with colleagues. Mediator Paul Finn to speak at William S. Richardson School of Law

University of Hawai‘i, Manoa William S. Richardson School of Law Classroom 1 Wednesday, Mach 15, 2017 5:30 PM – 7:30 PM Visitors are welcome! Boston based mediator Paul Finn has mediated over 7000 claims since beginning his practice in 1992. He was the mediator who successfully resolved the 552 claims of alleged victims of sexual abuse by priests from the Archdiocese of Boston. For this work he was named one of the Lawyers of the Year by the Massachusetts Lawyers Weekly 2003. He resolved all the claims for 335 claimants who filed claims resulting from the Station Fire in West Warwick, Rhode Island. Rhode island’s Federal District Court appointed Finn the 468(B) trustee to oversee the distribution of the funds collected during that mediation. He also was the led mediator in the claims filed by the DelValle family against the contractor and sub-contractors who built the tunnel system under the city of Boston.  Recently Mr. Finn mediated and resolved all the cleric sexual abuse claims brought against the Archdiocese of Milwaukee. Mr. Finn has successfully mediated claims in Rhode Island, Connecticut, Maine,  New Hampshire, New York, New Jersey, South Carolina, Minnesota, Wisconsin, Oregon, Washington, Colorado, California, Texas, Illinois, Georgia, Nevada, Mississippi, South Carolina, Illinois, Florida, as well as Massachusetts. He is the original author of Massachusetts Practice Series, Volume 47, Mediation & Arbitration. The seventh edition was published in 2015. Free Brown Bag Lunch Talk March 16, 2017 Noon to 1 PM March 1, 2017 (Hilo, HI) – The non-profit Ku‘ikahi Mediation Center hosts a free talk on March 16, 2017 as part of their “Finding Solutions, Growing Peace” Brown Bag Lunch Series.  Talks are Third Thursdays from 12 noon to 1 pm in the Office of the Prosecuting Attorney at 655 Kilauea Avenue in Hilo. This month’s speaker is Andrea Pro on “Taking the Scariness Out of Conflict.” “Underneath most conflicts are differences that are simply expressions of our uniqueness,” says Pro.  “It’s a great loss for everyone when we shy away from exploring our differences.” In this interactive mini-workshop, explore why we fear conflict and how to take the lead in forging a safe container to invite open dialogue with others.  We’ll look at three must-have skills for navigating differences with clarity and confidence. Andrea Pro is a communication and relationship facilitator in Kona.  Her work involves a heart-opening process of self-discovery along with communication tools and skills that support people in deepening authenticity, trust, and respect in their relationships.  A business owner for over 30 years, Pro is also a professional artist and uses these skills daily in her personal and work relationships.  She is a Certified Trainer with The Center for Nonviolent Communication.
